Privacy Policy

Tracktsport ("Tracktsport", "we", "us", "our") is an AI-powered sports performance platform operated by Adriano Montague-Brown, based in Auckland, New Zealand. We provide tools that help amateur and semi-professional sports clubs track player wellbeing, analyse video footage, and generate coaching feedback.

We take privacy seriously, particularly because our platform involves health and wellness information and may include data about people under the age of 18. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. It applies to everyone who uses the Tracktsport platform : clubs, coaches, players, parents and guardians, and website visitors.

We handle personal information in accordance with the New Zealand Privacy Act 2020 and the Information Privacy Principles (IPPs).

1. Who we are and how to contact us

Tracktsport is operated by Adriano Montague-Brown, sole trader (and, where incorporated, the operating entity that succeeds it). Our contact details are:

2. What information we collect

We only collect information that we need to operate the platform and deliver the features clubs and coaches have signed up for.

2.1 Account information

Name, email address, and password for coaches, club administrators, players, and parents or guardians who hold accounts. Club name, sport, age group, and role (coach, assistant coach, player, parent/guardian, administrator). Billing information for the club or person paying for the subscription, including name, billing address, and payment confirmation details. Card details are handled by our payment provider : we do not store full card numbers.

2.2 Health and wellness data

Players (or their parent/guardian, where applicable) may enter or be asked to enter the following:

Sleep scores or sleep duration Energy levels Muscle soreness Mental readiness or mood ratings Injury status, training load, and other wellbeing markers a coach has configured

Under the Privacy Act 2020, this information is treated as health information and given a higher level of care.

2.3 Performance and training data

Match and training participation, position, and minutes played Performance statistics entered by coaches or generated from video Goals, drills completed, and notes recorded by coaches

2.4 Video footage

Match and training video uploaded by coaches or club administrators. Metadata associated with the video (date, opponent, drill type, tags). AI-generated annotations, clips, and analysis derived from the video.

2.5 AI-generated outputs

Coaching feedback, meal plans, training suggestions, and performance reports generated by our AI features based on the inputs above. We retain these outputs so coaches and players can review them over time.

2.6 Technical and usage information

Device type, operating system, browser, IP address, and approximate location (derived from IP). Pages visited, features used, time spent, and error logs. We use this to keep the service running and improve it.

3. How we use your information

We use the information we collect to:

Provide and improve the Tracktsport platform. Generate coaching feedback, meal plans, performance reports, and other AI outputs requested by coaches and clubs. Allow coaches and authorised club staff to review player wellbeing and performance. Allow players and, where relevant, parents/guardians to see what has been recorded about them. Communicate with you about the service : account notices, updates, support, and security alerts. Process payments for subscriptions. Keep the platform secure, prevent abuse, and comply with our legal obligations.

We do not use your personal information for advertising, and we do not sell your data to anyone. Ever.

4. AI processing and third-party providers

Tracktsport uses third-party artificial intelligence providers (for example, large language model and video-analysis providers) to deliver some of our core features. To produce coaching feedback, meal plans, and performance analysis, we may send relevant inputs : including health and wellness data, performance data, and video : to these AI providers.

When we do this:

We only send the information needed to produce the output requested by the coach or club. We choose providers who offer enterprise or business-grade terms that limit how they can use the data. In particular, we use providers who agree not to train their general models on our customers' data. AI providers act as our processors and must handle the data in line with this Privacy Policy and our contract with them.

On request, we will tell a coach or club which providers we currently use for which feature.

Because AI outputs are generated automatically, they can be wrong. AI-generated feedback, meal plans, and reports are tools to support coaches : they are not a substitute for professional medical, nutritional, or coaching advice. See our Terms of Service for more on this.

5. Players under 18

Many of our users are children or young people playing club sport. We take this seriously.

We expect clubs and coaches to obtain consent from a parent or legal guardian before creating an account for, or entering health data about, any player under the age of 18.

Clubs must have a lawful basis under the Privacy Act 2020 to collect health information about junior players, and must tell players (and their parents/guardians) what is being collected and why.

Where reasonably practicable, we recommend that the parent or guardian holds the account for players under 16, and that older juniors (16–17) hold their own account with parent/guardian visibility.

A parent or guardian can ask us, at any time, to access, correct, or delete information held about their child. We will work with the club to action requests promptly.

We do not direct marketing or advertising at children.

6. Who we share information with

We share personal information only in the ways described below.

6.1 Inside your club

Coaches and authorised club staff can see the data of players in squads they manage. Players (and their parents/guardians, where relevant) can see their own data and AI-generated outputs. Club administrators can see account-level information for the club they administer.

6.2 Our service providers

Hosting and infrastructure providers that store and run the platform. AI providers that process inputs to generate outputs, as described in section 4. Payment processors that handle subscription billing. Email and communication providers that deliver service notifications. Support, analytics, and error-monitoring tools that help us keep the platform reliable.

All service providers are bound by contract to use the data only for the purposes we instruct, to keep it secure, and to comply with applicable privacy laws.

6.3 Legal disclosures

We may disclose personal information where we are required to by law, by a court or regulator, or where disclosure is necessary to protect someone's safety. Where we can, we will tell the affected person before we disclose.

6.4 Business changes

If Tracktsport is sold, merged, or restructured, personal information may be transferred to the new owner. The new owner will be required to honour the commitments in this Privacy Policy.

6.5 No selling, no advertising

We do not sell personal information. We do not share it with advertising networks or data brokers. We do not allow third parties to use the data we hold for their own marketing purposes.

7. Where your data is stored

Tracktsport stores data on cloud infrastructure that may be located in New Zealand, Australia, the United States, or other countries. Some of our AI providers process data in the United States or the European Union.

Where personal information is sent overseas, we take reasonable steps to ensure it is protected by comparable standards to those required by the New Zealand Privacy Act 2020, including through contractual commitments with our service providers.

8. How we protect your data

Data is encrypted in transit using industry-standard TLS. Data is encrypted at rest using industry-standard encryption (such as AES-256, depending on the storage provider). Access to production systems is restricted to authorised personnel and protected by multi-factor authentication. We log access to sensitive data and review logs regularly. We carry out routine security reviews of our platform and our providers.

No system is perfectly secure. If we become aware of a privacy breach that has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and the affected individuals as required under the Privacy Act 2020.

9. How long we keep your data

We keep personal information only as long as we need it for the purposes described in this policy, or as required by law.

Active accounts: We keep your data for as long as your club has an active subscription and account.

Cancelled subscriptions: After a subscription ends, we retain club and player data for up to 12 months to allow re-activation. After that, data is deleted or anonymised, except where we are required to retain it (for example, financial records for tax purposes).

Player removed from a squad: If a player leaves a club, their personal records become inactive in the platform and are deleted within 12 months unless the club instructs otherwise within that period.

Backups: Information may persist in encrypted backups for a short additional period (typically up to 90 days) before it is permanently overwritten.

10. Your rights under the Privacy Act 2020

Under the New Zealand Privacy Act 2020, you have the right to:

Access the personal information we hold about you (IPP 6). Request correction of information that is wrong, incomplete, or out of date (IPP 7). Withdraw consent for collection or use of your information where we rely on consent. Ask us to delete personal information we no longer need to hold. Complain to us, or to the Office of the Privacy Commissioner, if you think we have mishandled your information.

To exercise any of these rights, email us at adriano@tracktsport.com. We may need to verify your identity before we act on a request. We aim to respond within 20 working days, as required by the Privacy Act.

11. Cookies and similar technologies

Tracktsport uses cookies and similar technologies only where they are essential to operating the platform.

Essential cookies: keep you logged in, remember your preferences, and keep the service secure.

Analytics: we may use privacy-respecting analytics that count visits and feature usage in aggregate. We do not use cookies to build advertising profiles of you.

We do not use third-party advertising cookies or tracking pixels. Your browser settings can be used to block or delete cookies, but the platform may not work properly without essential cookies.

12. Marketing communications

We may send you product updates, security notices, and information about features relevant to your account. We will not use your information to send you third-party marketing.

You can unsubscribe from non-essential emails at any time using the link at the bottom of those emails. Some communications (such as billing notices and security alerts) are essential to the service and cannot be turned off while you have an active account.

13. Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes (for example, new categories of data, new processing purposes, or new categories of recipients), we will notify clubs and account holders by email and update the effective date above. Continued use of the platform after a change becomes effective means you accept the updated policy.

14. How to make a complaint

If you believe we have not handled your information properly, please contact us first at adriano@tracktsport.com. We will investigate and respond promptly. If you are not satisfied with our response, you have the right to refer the matter to the Office of the Privacy Commissioner of New Zealand at www.privacy.org.nz.
